These Terms of Service (“Terms”) govern your use of cxovideo.com and any related inquiry, sales call, or engagement with CXO Video (“we,” “us,” or “our”). By using the site or purchasing services, you agree to these Terms.
Services
CXO Video provides executive content production and related services as described on this site and in any proposal, statement of work, or order you accept. Website descriptions are informational. The scope, fee, timeline, and deliverables for a paid engagement are defined in the signed proposal or SOW for that project.
Sales calls and no obligation
Booking a sales call does not create a paid engagement. A paid project begins only when both parties accept a written proposal or SOW (including payment terms).
Fees and payment
Fees, payment schedule, and any applicable taxes are set out in your proposal or SOW. Work may be paused if invoices are overdue. Unless otherwise stated in writing, fees are non-refundable once production has begun, except as required by law or as expressly stated in your agreement (including any satisfaction guarantee described there).
Client responsibilities
You agree to:
- Provide accurate information needed to scope and deliver the work
- Secure any required permissions from executives, agencies, or clients you represent
- Provide timely feedback and approvals so delivery dates can be met
- Ensure recording environments and brand/legal constraints are shared in advance when relevant
Intellectual property
Unless your signed agreement says otherwise, upon full payment you (or your client, if you are the agency of record) own the delivered portfolio for commercial use. We may retain the right to show anonymized or approved examples of process and craft, and we retain ownership of our pre-existing tools, methods, and templates.
Acceptable use of the site
You may not misuse the site, attempt unauthorized access, scrape content at scale, or use the site in any way that is unlawful or harmful to us or others.
Disclaimers
The site is provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Results of marketing or thought-leadership content depend on many factors outside our control; we do not guarantee specific business outcomes.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to the site or services is limited to the fees you paid us for the engagement giving rise to the claim (or, if related only to use of the site, one hundred U.S. dollars).
Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the site, your breach of these Terms, or content or instructions you provide that infringe third-party rights or violate law.
Governing law
These Terms are governed by the laws of the United States and the state in which CXO Video primarily operates, without regard to conflict-of-law rules, unless your signed SOW specifies otherwise.
Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the site after an update means you accept the revised Terms. Signed project agreements control over these website Terms where they conflict.
Contact
Questions about these Terms: use Talk with Joel on the site, or the contact method in your proposal or engagement materials.
